Im 32yrs old this yr , im currently a co-owner together with my elder brother and my mum . This year im getting married and intend to get a resale flat together with my fiancee but due to some family issue my brother is not willing to let me remove my name and not willing to sell the flat . Is there anways i can remove my name asap

Hi Kok Wei,

It will not be prudent for us to advise without understanding the situation fully. I believe within a family, it would be helpful to find out more about the concerns of your brother for removing your name from the current place. Is it due to finances or is it for other reasons?

How about your mum and dad? In order for you to remove your name, you will need HDB to approve this as well and consent from your fellow owners will likely be required too. Owners are not allowed to put up their properties for rent or sale on PropertyGuru. In fact they are encouraged to engage the services of agents to market their place if required especially for rental, due to the spike in scam cases for rent in recent times. Many tenants I have came across have indicated that they are now very careful and will prefer to deal with agents listings instead since it is more legitimate source of listing given that we are licensed to do real estate works. This works well for many landlords too, since we will also be required to do our due diligence on prospective tenants. If your concern is to save on agent fees, the good news then is that agent fees is only applicable when there is a successful transaction, therefore this amount of money can be built into the monthly rental price you get from the tenants. In this case, the tenants will be the ones paying the agent fees indirectly, so homeowners like yourself will enjoy the professional level services while not worrying about having to pay for the marketing fees even if there is no confirmed tenants.

1) There are only 2 ways to remove your name from a residential property:
(a) Gift
(b) Part-share selling

2) The main difference in the above 2 methods is that transferring your share via gift is no profit from the transfer, whereas part-share selling receives profit from the transaction.
3) Both methods incurred similar legal fees and stamp duty.
4) Most people will use the part-share selling method because transfer via gift requires the property free from mortgage.
5) However, the HDB also allowed changes of ownership (Not through a sale); https://www.hdb.gov.sg/residential/living-in-an-hdb-flat/changing-owners-occupiers/change-in-ownership/change-in-flat-ownership/guide-on-transfer
6) This is similar to part-share selling except that you will not profit from the transferring.
7) Your brother will have to pay for funds utilized from your CPF with accrued interest.
7) He can apply for a mortgage on top of the existing loan to pay for CPF utilized with accrued interest.
8) Your brother might be concerned about servicing the increment in the monthly mortgage after the share is transferred/sold to him.
9) You are not able to remove your name without the consent and cooperation of your brother.
10) As a family, I still believe there is a way to talk to each other to solve a problem.
