Hi Candy,

The only way to claim against the tenant is to file small claims against the tenant. If the tenant is leaving for SG for good, I think that will probably be a waste of time. Just move on and quickly secure the next tenant. Resolving disputes can take time thus important thing is to get the next tenant in as soon as possible in a weak rental market currently.

I have been in the real estate business since 2009, with more than 14 years of experience serving the Singapore real estate market.

I am very active in the residential segment of Singapore real estate market, having transacted hundreds of deals from HDBs to private condominiums and landed properties in Singapore, and have handled many unique cases in sales and purchases as well as rental deals.

Over the years, I have also established a network reaching out to more than 9,400 expatriates, bringing my market presence to both in and outside of Singapore. This has created an additional exposure when I manage my client's portfolios, on top of the conventional on and offline platforms, where other estate agents are relying on. This has allowed me to consistently convert leads into results.

With an evolving market, where change is the only constant, I have also been investing in upgrading of my knowledge and skills sets to improve myself and meet the demands of current and future market.

My Answer with regards to your Question:

As a HDB landlord facing a situation where your tenant is leaving the rental property early and not paying rent for the remaining months covered by the tenancy agreement, here are some steps you can consider:

Review the Tenancy Agreement: First, review the terms and conditions of the tenancy agreement to understand your rights and obligations as well as those of the tenant. Check if there are clauses related to early termination, rental payment, and security deposit.

Communicate with the Tenant: Reach out to the tenant to discuss the situation and try to understand their reasons for leaving early. Express your concerns about the unpaid rent and emphasize the importance of fulfilling the terms of the tenancy agreement.

Enforce the Tenancy Agreement: If the tenant is in breach of the agreement by leaving early without paying rent for the remaining months, you may take legal action to enforce the terms of the agreement. This may involve sending a formal demand letter requesting payment of the outstanding rent and informing the tenant of your intention to pursue legal recourse if necessary.

Use the Security Deposit: Since the security deposit held is insufficient to cover the unpaid rent, you can utilize the deposit to offset part of the outstanding amount. Document the deductions made from the deposit and provide a breakdown to the tenant.

Seek Legal Advice: If communication with the tenant does not resolve the issue and you need to take legal action, consider seeking advice from a lawyer specializing in landlord-tenant disputes. They can provide guidance on your legal options and assist you in taking appropriate steps to recover the unpaid rent.

Find a New Tenant: While pursuing payment for the unpaid rent, start looking for a new tenant to minimize any further loss of rental income. Advertise the property, conduct viewings, and screen potential tenants to find a suitable replacement.

It's essential to handle the situation professionally and in accordance with the relevant laws and regulations governing landlord-tenant relationships in Singapore. Maintaining clear communication and seeking legal advice if needed can help you resolve the issue effectively.
