Landlord is not responding to when they will return us our security deposit neither letting our contractor to rectify the issues that were raised up during handover. The unit is still available for rent, we are intending to proceed to file small claims tribunal as 14 days will be up soon. Can landlord still rent her place if there’s a case with small claims tribunal ?

Hi,

Yes the landlord agent can still advertise and to rent out the unit even though there may be a pending case.

The landlord can still rent her place. I encourage you to file the SCT as soon as possible if it is more than 2 weeks after tenancy has concluded.

I have been in the real estate business since 2009, with more than 14 years of experience serving the Singapore real estate market.

I am very active in the residential segment of Singapore real estate market, having transacted hundreds of deals from HDBs to private condominiums and landed properties in Singapore, and have handled many unique cases in sales and purchases as well as rental deals.

Over the years, I have also established a network reaching out to more than 9,400 expatriates, bringing my market presence to both in and outside of Singapore. This has created an additional exposure when I manage my client's portfolios, on top of the conventional on and offline platforms, where other estate agents are relying on. This has allowed me to consistently convert leads into results.

With an evolving market, where change is the only constant, I have also been investing in upgrading of my knowledge and skills sets to improve myself and meet the demands of current and future market.

My Answer with regards to your Question:
In most jurisdictions, including Singapore, a landlord is generally allowed to continue renting out their property even if there is a pending case with the Small Claims Tribunal (SCT). The SCT process is separate from the landlord's ability to rent out the property.

However, if the tenant has filed a case with the SCT regarding the return of the security deposit and unresolved issues, the landlord may have to address these matters as part of the legal proceedings. The outcome of the SCT case could potentially impact the landlord's ability to continue renting out the property in the future, especially if there are financial obligations or legal liabilities involved.

It's essential for both parties to comply with the SCT process and any rulings made by the tribunal. If the landlord fails to respond to the SCT case or comply with its decision, further legal actions or enforcement measures may be taken against them.

Before proceeding with filing a case with the SCT, it may be helpful to try resolving the issues through negotiation or mediation. If communication with the landlord has been unsuccessful, seeking legal advice or assistance from relevant authorities may be necessary to protect your rights and interests as a tenant.
