Hi Andy,

This is a technical legal issue relating to conveyancing. Its best to seek proper legal advice on this. But here is my advice on the subject.

should you wish not to sell the property, you may wish to take the following steps:

1. Get someone to buy out your joint tenant, there by breaking the joint tenancy and thus creating a tenancy in common with the new 3rd party.

2. Get your joint tenant to transfer their rights of the property to you for consideration of some $$. It may depend on negotiations how much you end up paying.

And to answer your question directly, they can't force a sale, as long as you refuse to sign the Sale and Purchase agreement, the transaction will not go through, but you may need to compensate the buyer, of which both joint tenants are liable to make payment to the buyer (if it is stated in the option).
