Hi Gurus,
Scenerio : My wife & I own 2 private properties. She's a PR & I'm a Sgp citizen.
Q1) Can I transfer both the property to her without paying any taxes?
Q2) Can I buy a resale HDB after I transfer the ownership of both properties to her?

Any reply or feedback will be greatly appreciated.

Hi,

It don’t work this way, as you are legally married so you can’t purchase a HDB flat using your sole name.

Hi,

Unfortunately no, she will have to incur Buyer Stamp Duty of 3% on the market value of the share ownership transferred, as well as ABSD of 5% (1st property) + ABSD of 25% (2nd property). There will also be Sellers Stamp Duty if you have held the property for less than 3 years.

You also cannot purchase resale HDB on your sole name as both of you are legally married. Both names are required.

Dear Sir,

I am assuming both of you own both properties together. You can do a part sale of your share to your wife but as she is a SPR, she is liable for the Additional Buyer Stamp Duty of 5% for your share of the first property and 25% of your share for the 2nd property.

If you sell your shares to her, you will also not be able purchase a resale HBD because under the current HDB rules, married couple is considered a single entity and you will need to include wife either a an owner or occupier. In this case, she will need to sell both her properties as part of the requirement to own a HDB flat.

If you wish to rebalance your portfolio, a better way is to transfer your shares of one of your property to your wife and sell the other property. In this way, you can free up your name to buy another property. The approach moving forward largely depends on your intentions and objectives, please feel free to contact me so that I can understand your situation better and provide you with further assistance.

Hi Sir,

Noted on your situation.

Stamp duties is payable for the value of shares being transferred. As a SPR, on top of the normal BSD, she will incur 5% ABSD and 25% ABSD for the first and second properties respectively. If she's the joint-owner, the stamp duties will be based on 50% of the transfer value.

After you had transferred the properties to her, you can purchase a HDB resale flat under Public Scheme, with your Wife as the essential occupier. She will then have to sell off both her private properties latest within 6 months of the HDB resale flat purchase. Do take note that she will be liable to pay 12% SSD should she sell the properties within the first year of the transfer.

Hence, the above moves does not make any sense. There has to be a much better way to go about your property plans. Perhaps you could share with me what's your plans going forward? I will be able to give you the most appropriate recommendation based on your profile and expectations.

Hi,

1) There are 2 types of processes that can be considered as transfer:
(a) By gift: the ppty is fully paid, no utilization of CPF.
(b) By part sale: done when CPF is utilized in this ppty, and/or there is an outstanding loan in this ppty.

2) Both methods of transferring are subject to stamp duty. The rate of stamp duty is the same for both types. ABSD is applicable for both types as well.
3) Since you are married, the HDB will consider you and your spouse as a single entity when buying an HDB flat. It implied you cannot buy without including her name and vice versa.
