My late husband and I hold a property in “Joint Tenancy”.

1. By the Law of Survivorship, the property is transferred to me even though the title deeds still show our both names? Is this correct?
2. In the event of sale, can I execute the sale alone even if the title still show 2 names?
2. Is there anything extra the conveyancing lawyer need to do for such cases?

Hi Mdm,

Sorry to hear about your loss. You will need to lodge a Notice of Death to SLA so that SLA can update the records accordingly.

Good afternoon,

Sorry to hear about the situation, I hope you are managing well. Yes based on Joint Tenancy, the law of survivorship applies and his ownership share is transferred to you. However on your end you have to make an official Notice of Death lodgement with SLA to update the SLA records.

Once completed, you can execute the sale accordingly. Whether there are extra details required, the conveyancing firm will advise accordingly once we have all the details.
