Can I be the main applicant and my spouse be the essential occupier during buying resale HDB? Then is my spouse consider first buyer for 2nd property after 5yrs MOP? Besides, is the main applicant must be SC or SPR also eligible? Thanks.

Good morning Mr,

It's perfectly fine to purchase under 1 one owner and 1 essential occupier in your resale HDB purchase as long as both of you are SPR + SC or SC + SC.

The essential occupier can proceed to purchase a private property after MOP without being subject to ABSD based on existing regulation.

Lastly if SPR is the owner while SC is the essential occupier, you will subject to ABSD with this ownership arrangement as SC is not owner and not qualified under IRAS' term of matrimonial home. You can double confirm with HDB on this.

Have anyone work out your numbers for your purchase yet? Spoken to any banker or apply HLE?

Good morning,

Yes its fine to purchase as 1 owner 1 essential occupier arrangement, either 1 SC + 1 SPR or as 1 SC + 1 SC.

As of current regulations, the essential occupier is not considered the owner of the property, and after 5 years MOP are fulfilled, he/she can purchase next residential property without ABSD.

To my understanding, SC can be sole owner of the HDB if they opt for 1 owner + 1 essential occupier arrangement, but not SPR. The ABSD rate based on SPR 1st residential is also higher by 5%.

The main applicant must be a SC. It is possible for your spouse to be an essential occupier so that he or she can purchase a private condo without the ABSD for a 2nd property after the 5 years MOP.

Take note that main applicant has to be SC in order to own the HDB under such arrangement. Your wife can be the essential occupier, thus freeing her name to purchase a 2nd property after MOP for this flat is met. With current additional buyer's stamp duty rate, she will only be paying 5% ABSD for her purchase if that is going to be her 1st residential property in Singapore.
