My parents got divorced. HDB to be transferred to my mother's sole name. She is a Singapore PR. I am a citizen. I understand I can be put down as an occupier.

In that scenario, will I have an MOP of 5 years after the transfer is effected? If yes, then when I get married, do I still have to remain in the HDB Flat for that 5 year period? Or can I rent another property with my wife?

Hi

To my understanding, yes your mum has to form an eligible family nucleus with you as the essential occupier to be able to keep the HDB. This means both of you will be bounded by the 5 year MOP, and have to stay in this HDB for the next 5 years. And cannot apply for new flat while serving the MOP period.

You may want to ask her to confirm with HDB branch officer on this, and or try to appeal if above is the scenario.

You will be the essential occupier in this case, since as a SPR, your mother cannot own a HDB under her sole name. If your HDB has already fulfilled its MOP, it is likely that there is no new MOP to fulfill for the flat after the transfer, however, do take note that should you decide to apply for your own flat in future, your mother will not be able to hold on to this HDB if she remains a SPR. It will be good if she can consider taking up citizenship if being offered to do so.
