Can a buyer back out from buying a HDB resale flat when the option has been exercised because they are unable to sell their unit in time for the finds to be used for the unit they intended to buy. Please advise thanks

Legally speaking they cannot back out, but any claims for damages have to be done through a private lawyer.

Hi Kay Kay,

1) This is definitely a very disruptive action from the buyers because usually the sellers also have their own plan for the next home which is involved with the selling.
2) Legally anyone can break the contract and bear the consequences of voiding the OTP.
3) The minimum claim you can have is to accept the option + exercise fees and wait for the next buyer.
4) You will need professional legal advice from a practicing lawyer to understand what more you could claim from the seller. Especially you could have also placed a deposit and exercise for your next home.
