Can I set up trust for my child instead of sell off the HDB flat? I m wondering why my colleague friend can owe 2 HDB flats and rent out one after inherit from his mother? It almost more than 4 years.

Hi Sir/Mdm,

It is not possible to hold a HDB under a trust. For your colleague's case, to hold on to 2 HDB, they must be able to satisfy the criteria of holding a HDB for each of the flat. They may be holding under single ownership for each flat. Please feel free to contact me so that I can understand your objectives and assist you further.

One household or family nucleus can hold only one HDB at any point of time. They should have fulfilled certain eligibility conditions that they are able to do so. Perhaps you can find out more?

But care to share whats your intention about this move so I might be able to come out with an alternative.

Hi,

It is not possible to hold an HDB under trust, as HDB regulations does not allow that. It could be possible that the HDB is inherited by one of your colleague's siblings? Regardless, a family nucleus household is only allowed to hold onto 1 hdb at any one point of time. They must have fulfilled certain criteria set out by HDB. Subletting approval also goes through HDB, so any violation would have meant the approval can't be obtained.

Hi,

1) There are many reasons behind what your friend is able to "own" 2 flats.
2) It is not so many that it is impossible to list down all possibilities. But all of them could have violated certain laws not necessarily only the HDB.
3) So don't have to explore down that route, not everyone comes clean telling you the whole truth. Just treat it as hearsay.
4) The HDB basic rule is simple, every single SC entity (single or family) is only entitled to own 1 HDB flat. Otherwise, it will be unfair to all the other SC entitles.
5) Buy property under trust not only this is only applicable to private property, the payment for the property also has to be in cash only.
6) It is more common that your child is under the legal age of 21 when buying a property under trust.
