Dear Guru,

Our agent have created a lot of confusion and frustration in communicating and arranging for viewing, valuation, etc, with the seller side. As buyers, this has created a lot of stress and consumed a lot of time unnecessarily. How do we go about discharging him while we are 6 months away from the sale completion? What are the pros and cons? We are not paying him commission, so this is not the issue. We feel that he is not acting in our best interest and worry his negligence will create serious problems and misunderstanding. Thank you in advance for your advice

I assume this is a private property you are talking about.

If valuation has already been done, I do not think there is anything else that can go wrong unless there is special terms and conditions coming along with the sale.

The remaining issues should be settled by the conveyancing team. You may get in touch with them more closely to keep yourself updated.

I don't see any reasons for terminating a salesperson at this junction since you are not paying commission.

    Yes it is private property. No, the valuation has not been done.

    Correction to my initial post: the sale will have to complete by end of September 2016.

    The agent has negligently, for example, facilitated the wrong completion of offer to purchase document (Date is in the wrong month, fields not filled in properly), and delivered the wrong document to me as fait accompli with an official option to purchase, retaining the 1% option fee.

    There are many other such negligence, for example mismatch between the date of offer of purchase (mismatch by 1 month) and the date of completion on the offer to purchase and the option to purchase.

    I see myself being at risk from being represented by this agent given what is at best carelessness and incompetence, and at worst a deliberate act of deception.

Transaction already pending, just wait patiently for the house.

The transaction completion need to seek both parties acceptance before instruct the law firm. It a common practices, completion date.

Example case-

My seller wanna the completion with 4 weeks, whereby the buyer wanna the completion at 12 weeks.

We always follow the latest date. To avoid any issues by either parties occurred if period too short especially for fund transfer from overseas.
