Dear Gurus,
I am currently renting a room (have been staying here for the past 9 months) and my tenancy agreement (TA) will expire in Dec 2023. Under my current TA, it is actually 6 months min stay + 1 month notice (diplomatic clause). I am planning to renew my lease before it expires. I have a few questions:
1) Is a new TA required?
2) Can the new TA/extension of TA be based on the same terms and condition (ie. a contract of 1 year but it is a diplomatic clause of 6 months min stay + 1 month notice)?
3) During my current TA, I had to pay a 1 month deposit. When I renew the TA, do I also have to pay a 1 month deposit?
4) Also, does my landlord have to engage the same property agent and does my landlord also have to pay commission to the property agent even though it is just a lease extension?

There is no hard and fast rule on the agreement for renewal, but for point 3, deposit is refundable at the end of each tenancy, thus if there is no change in rental, there should not be a need to pay any further deposit. If you are unsure, why not engage an agent? Commission can also be applicable for lease renewal but that should be between your landlord and the agent.

1) Would encourage you to use a new TA.
2) Negotiate with landlord.
3) At the end of your current lease if all is good, it is possible that your SD is utilised for the next lease period.
