Dear Gurus,

I have a few questions with regard to renting:

(i) Currently, I have a apartment unit to be rented out. There is a agent who approach me to rent out my unit. He has a direct tenant.

Q: Can this agent represent both the landlord and tenant since there is conflict of interest when it come to negotiating of price and T&C.

Q: What is the agent fee that i need to pay if this is for rental of 24mths with monthly rental of $4600 ?

Morning John,

With the current CEA ruling, if the agent has a direct tenant, he need to choose which side to represent.
Once he starts to advertise for you, it's deem that he is representing you, hence he cannot collection commission from the tenant.
The commission payable is 1 month for lease of 24 months or less, but more than 12 months.

In today's regulated market, an authorised real estate agent can only act on behalf of either the landlord or tenant for the same property transaction.

By acting, an underlying documented CEA form will highlight the representation which covers the responsibilities and also the commission.

A professional agent are not able to represent both landlord & tenant in the same property transaction.

The market rate is 1 months rental for 2 years lease on the average scenario.
