Does heavy stained marked on mattress consider as wear and tear? Tenant stayed in the room for 3+ years and we noticed the heavy stained on mattress after they have moved out. Those stained were not there previously but tenant said it was there but didn't informed after moving in (but have reported some defect/condition). Can we claim the cost of either mattress cleaning or replacement of mattress (reasonable cost) from the tenant's deposit? Thanks

It is up to individual to proof their case in this respect and given that there is an absence of reporting this defect when they moved in, you do have a case to claim against the tenant, especially if they have feedback on some defects and conditions when they take over the property, but if you are planning to settle this case amicably, you may wish to see if the tenant is willing to do cost sharing on the replacement or cleaning of the mattress.

Hi,

Is there any photo taken during the handover of the unit to tenant? The stain mark on the mattress will not be a case of wear and tear and you as a landlord will definitely have a case to it. As for me, I would usually advice my landlord to buy a mattress protector so as to protect the mattress from any stain. And if there will be stain mark on it after the end of the lease, then I would charge the tenant accordingly for replacement of a new mattress.

    Thanks for the reply. Unfortunately no photo was taken during the handover. It was tenant that informed the condition/defect of items in the room. Mattress protector was provided when they first moved in. However, there wasn't a mattress protector left behind when they moved out and was told they no longer have that! They claimed they have been buying new mattress protectors just to cover the stain regularly which I don't find it persuasive as mattress protector are washable.
