Hello, I am hoping to seek some wisdom as my situation is rather complex.

To summarise, I am a 23 y.o single male this year, with no concrete intentions to get married yet. My grandma's health has been declining as of late and will be leaving behind a HDB flat located in a prime area to her 3 children. Currently, all 3 of her children already own 5-RM HDB flats and are unwilling to sell their existing flat to downgrade to a much older 3-RM HDB flat despite it being in a prime location. Additionally, all of their children (my grandma's other grandchildren and my cousins) are younger than me, single and have no interest in taking over the flat as well.

As the HDB flat is located in a good location, I am keen on taking over the flat. However, to my understanding, I am unable to inherit it as I am not an immediate family member nor can I purchase it on the resale market as I am still below 35. Additionally, my grandma may only have a few more months to live, thus there is an element of urgency.

May I know what are my options if I still wish to take over the flat? All 3 of her children also wish to keep the flat within our family if possible and are thus supportive of me taking over it if possible.

Hi Sean,

Sorry to hear about the conditions of your grandma. You are ineligible to retain the flat as a sole owner in this case since you are not married, regardless if you have the support or agreement of other family members. Even if your grandma leaves a will for the HDB to be left to you, you will still need to sell it upon the transfer since you do not fulfill the criteria to own a HDB.

Hi Sean,

Sorry to know about your grandma's condition. For your case, you will not be able to retain the flat as a single unless you are married. In the event that nobody is willing or eligible to take over, HDB will direct the flat to be sold in the open market.

Hi Sean,

1) Let's say your grandma set up a will to leave the flat to you. Under the HDB policy, you are not able to keep it even for your own stay.
2) If no will is set up and leave it to the Intestate Succession Act, though the processes are more complex. Her children although can transfer their shares in the HDB flat to you, you too are unable to keep it.
3) So under either situation, the only option is this flat will have to be sold in the open market to whoever is eligible to keep it.
4) I'm sorry to say that even if you put up an appeal within your own capacity or through an endorsement from the MP, the chance of success is very slim.
