Hi Cindy,

If the seller appoints an exclusive agent to sell, in most exclusive agreements, the clause states:

In the event that the sale of the Property is not completed by the Purchaser for whatever reasons, one half (1/2) of any option money, deposit or sums paid on account of any purchase of the Property forfeited by the Vendor, shall be paid to the Agency subject to a maximum sum equivalent to the commission plus GST.
