Hi Guru, I've 2 properties jointly owned (50/50) by my spouse and myself. I intend to de-couple both properties in order for my spouse to buy a resale condo. If I decouple, based on which amount (purchase price or market value) should I reimburse my wife's share & what is the stamp duty I have to fork out for both units. Appreciate very much any Guru's advice. Thanks in advance.

Hi Mr. Segar,

The stamp duty is based on purchase price or market value (IRAS determined), whichever the higher. You have to refund the CPF OA utilized by her for the properties, and be able to finance the remaining home loan on your own. Its best to do some preliminary planning for the most cost effective way to reach your objectives. Without more figures, I can't estimate the costs required. In any case you need to engage a law firm to do the decoupling.

The stamp duty to be forked out will be based on the IRAS determined Market Value of the property. As this decoupling process requires the amalgamation of the finance (CPF related matters) and the legal wing, it is best to do some planning and discussion to be able to advise you step by step, in the most thorough manner, to prevent any liquidation trap.

Stamp duty is based on market value determine by IRAS .

In addition. ABSD rules apply when buying over the part share .

ABSD varies from number of property count and nationality too , meaning ABSD is payable by one of the eventual owner because the owner will have 2 property despite de-coupling .

Alternatively , if both you and spouse are singaporeans , you may consider selling both existing properties, thereafter each buy a property individually WIHOUT PAYING ABSD .

May I know what's your objectives of doing so? Is it to save on ABSD? Or to qualify for more loan?

De-coupling on both properties may not make perfect sense in this case. Are you aware that there are other ways which you can explore to own a 3rd property?
