Hi gurus, my spouse currently owns a 3 rm BTO flat under her name only. I am listed as an occupier.

Can she sell the 3 rm BTO flat and upgrade to a 5 rm resale flat under her name only?

Purpose is for me to buy a private property under my name without paying ABSD.

Good morning,

Yes she can upgrade to a 5RM as sole owner but with you under the same arrangement, essential occupier.

As both of you are married, family nucleus is required to be eligible to purchase a resale HDB.

Do take note that you can only purchase a private property under your sole name on or after MOP of the 5RM flat. Will you be able to wait?

Yes, this is possible. You will be listed as an essential occupier and will also need to observe the 5 years MOP after taking possession of the 5 room flat before you are eligible to purchase a private property under your name without paying ABSD. This is based on current regulations.

Hi,

If the MOP of 5 years is met, she can sell the existing BTO and upgrade to 5-room. However as both of you are married, both names need to be included as either co-owners or owner and occupier arrangement for the 5-room purchase to form the family nucleus to be eligible. Thereafter have to serve another 5 year MOP before you are eligible for 2nd property purchase.

Alternatively if the MOP of the current flat is already met, you can combine finances and purchase the next property under your sole name so to avoid ABSD. And keep the 3-room BTO for rental income.

Yes this is possible and I have assisted a few of my clients to structure their purchase this way but there are some issues to consider especially if you are taking a HDB loan. As the occupier of the 5 room resale flat, you will need to observe the 5 years MOP as well. After the 5 years, you will be free to purchase a private property without ABSD.
