Hi,

I have some questions to rental here.

My tenants has breached the clause of the tenancy contract where " No subletting is allowed and landlord have the right to terminate the contract." I have actually asked all tenants to leave on the spot when I found out. But they ask for extension.
1)Is there a time I grace I should give them to do so?

2)If they refused to leave, what should I do? My agent seems to have disappeared so I dont have my agent to help and have to do all these myself.

Now I am asking the main tenants to leave. But one of the tenants refused to leave and wanted to lodge a complaint against me. He wants to get back the security deposit and also to complain that I trespass the property.

1)How is it possible when I have knocked the door and one of the tenant opened the door for me to go it. Am I wrong to do that?

2)Will there be any chances he can get back the security deposit?

Hi Lex,

You are entitled to ask them to leave on the spot as it is a breach of tenancy. Of course, it also depends on what was listed in your tenancy agreement. However, out of goodwill, and in order not to let things turn too ugly, you may wish to grant them a few days extension. Afterall, this is your own property and you may want to prevent any foul play should they decide to turn nasty.

You may like to lodge a police report. I would suggest you get a 3rd party, probably their own agent or a new agent to help to solve the issue for you. If there is a breach of contract, you are not required to return the security deposit to them. As for the trespassing issue, I would say that is not a big issue to worry about since the tenants have opened the door for you to go in.
