I owned a 3 room hdb flat before getting married. Currently the flat is still under my name and my spouse as an occupier. We have intent to purchase the flat next door to upgrade to a Jumbo flat while getting another condo. How do we proceed without ABSD?

Hi,

It is possible, but your plans of getting the condo will have to be shelved for at least 5 years. This is because you will need to serve a fresh 5-year MOP should you purchase another HDB flat.

Should you choose to do that, your spouse will need to remain as the essential occupier of the flat, and he/she will be able to purchase a condo without incurring ABSD.

Dear Sir/Mdm,

Such a scenario is called a conversion scheme, under such an arrangement, you will need to purchase the next door unit either with your spouse or your parents by forming a family nucleus.

If your spouse name is included, she will not be eligible to purchase a condo within the next 5 years due to the MOP requirement. If she is still an essential occupier after the purchase, she is able to purchase a condo without ABSD after 5 years.

You may wish to proceed to purchase the adjorning flat alone with your wife named as an occupier. Your wife may only purchase a private property after 5 years without incurring ABSD should your wife is not named as the owner of the HDB. This is because the requirement for conversion scheme if that you have to form a family nucleus and your wife is thus regarded as an essential occupier where the MOP period is applicable to her as well. Do note if you have taken singles grant for your 3 room flat previously while your wife have not taken any grant in the past, you may apply for a top up grant to reduce your current outstanding loan before proceeding to purchase the unit next door under conversion scheme.
