Hi, my dad, a widower, has dementia and is staying in nursing home. We intend to sell his HDB flat. He has LPA done and we have gotten medical report to certify his lost of mental capacity. May I check how do we kick start the selling of his HDB flat? Thanks.

Hi Mr. Chong,

The appointed Donee or Donees must have the powers to decide your father's property affairs, and with all the legal documents ready. It is good to consult the law firm that draft up the LPA on anything that needs to be taken note for the sale to happen. If they have the powers to decide your father's property affairs, the appointed Donee or Donees will have to check and verify with the HDB branch officer and confirm and register their legal donee status so to be able to initiate the sale. Thereafter the steps would mostly be online through the resale portal.

I am assuming that the LPA done up earlier includes the power for the donee to make decisions and take charge on the matters related to the property, so in this case, you will need to approach HDB branch office with all legal papers as well as medical documents for HDB to register this case and do necessary documentation before you can initiate the sales process through registering the Intent To Sell via the HDB resale portal.

As your LPA is done already, the next step would be to liaise with the HDB branch office so that you can register the Intent to Sell for your dad. Once the Intent to Sell is done, we can then start marketing the flat for sale.
