Hi - we are a married Sg citizen couple and are nearing 5 years occupation in our condo. We would like to buy a second condo. Now, If I sell my part share to my wife - does the minimum period of occupation in current condo get reset to additional 5 years due to this decoupling process

Good morning Arun,

Did you purchase an EC? But nevertheless not to worry on that. You dont have to fulfill any minimum occupation period if you decouple the property.

But do take note if you guys decide to sell off this property within the next 4 years, you will be subject to seller's stamp duty for the share of ownership that you sell to your wife in the decoupling.

MOP does not apply to Private Condos.

You can purchase as soon as you decouple. In fact you can purchase even without decoupling.

Evening,

I would either assume that the current unit you are staying in is an EC purchased from HDB or you are referring to the seller stamp duty. With EC, upon fulfilling MOP, it would be considered as private property. Hence there would not be any MOP requirement. However, SSD does apply, should you opt to sell it within 4 years after decoupling.

After de-coupling , you can proceed to buy a private property as per your plans.

However , your wife will be subject to regulations such as SSD sellers stamp duty on the part share that she bought over from you . Meaning NO SSD payable if she sell her condo AFTER 4 years ( from the day she bought your part share ) . Vice versa SSD payable on the part share she bought over from you if she sell her condo BEFORE 4 years .

Please note legal fees and stamp fees of 3% BSD ( buyer stamp duty ) is payable on the part share that is being sold during the so called de-coupling process . A free transfer cannot be done .

Alternatively , consider selling your family condo as a whole straightforward, thereafter each of you can buy a private property individually without paying ABSD .
