I am not satisfied with my agent's performance during the service period and I would like to terminate the agency agreement. However, i notice in the agency agreement, there is also a standard CEA clause about disputes going to mediation and arbitration. Hence, I would like to find out how I could terminate an agency agreement and if i terminate, could i get part of my commission paid back?

Also, if i am really unsatisfied with his work, what can i do? complaint to CEA?

Hi,
I would suggest you talk to his company management first. There could be a misunderstanding that they might be able to sort out. Otherwise, you can inform them of the termination. Once you receive their black n white, you can then proceed to get another agent to represent your interests.

By the way, yes you could terminate an exclusive at any point in time but the moment transaction has been sealed and commission already paid to the agency, it is unlikely you could claim any amount back.
