I currently have a Tenancy Agreement on a private condo which is due to expiry at the end of September 2010. We have just been informed that the owner has sold the property which isn't an issue as we knew it was on the market. I fully aware that the property has to be sold with the current TA, however we would prefer to vacate the property on completion of the sale which is likely to be prior to the expiry of the current TA. I'm assuming this is possible as our current TA will invalid on sale completion and if we were to stay a new TA sign with new named owner?

Hi Dave,

If your lease expired on Sept 2010, the property will be sold with tenancy -- this is clear on your part.
When a property is sold with tenancy there is no need for the buyer (new owner) to sign another tenancy with you as the both buyer's and seller's lawyer will be informed during the sales process, the tenancy and inventory list will be given to buyer's lawyer.. The new owner will take over tenancy lease and you as the tenant on completion date.
However, if you wish to vacant by completion date or before your lease expire you should be in communication with current owner or the sellers agent to request to the new owner.
The new owner can then negotiate through his lawyer for this purpose.
There may be a final inspection by the buyer the new owner before completion, you can touch base with them regards to this, or request thruough your current owner the same.

There is 2 probablities.. one if the buyer is an investor he may allow your early termination
if your rental is lower than current.

two -- if he buy the property for their own stay, he may want the house earlier than sept for renovation etc.
