For HDB sale, if you are using HDB lawyer, then the payment of commission will be separate. If you have engaged private lawyer for the conveyancing, you can give instructions to the lawyer to payout the commissions directly to your appointed agent.

1) There are 2 types of scenarios on the commission payment.
(a) Engage a private lawyer: The law firm will take the initiative to deduct the commission from the sale proceeds when it is a positive sale.
However, in a negative sales situation. The commission will have to be paid by the seller separately.
(b) Engage an HDB lawyer: The law firm will only take care of the refund to the CPF and the cash proceeds when there is any.
The commission will have to be paid by the seller separately.

2) The seller can only engage an HDB lawyer when it is a positive sale and the seller must either have no outstanding loan or with an outstanding loan with the HDB.
3) The seller must engage a private lawyer when there is an outstanding mortgage with a private bank.
