Asked by
I messaged an agent in April to express interest to view a unit. Both me and my husband were very interested in the unit and we asked to view for a second time. And after second viewing we made an offer and only then the agent said he's actually representing the buyer not seller hence the buyer will need to pay the agent commissionn claiming that the seller cannot afford to pay for it.
We were surprised back then because it was not mentioned in the first viewing but because we are first time home owner, and we liked the unit a lot we agreed to it.
Thereafter during the transaction only we found out that the seller is the agent's colleague. Is this allowed within the agent code of conduct?
We have already paid the commission but we were very unhappy about it. Can I lodge a complain to CEA and is this a valid complain?

Dear JY,

1. Yes, the agent should be upfront about collecting comms from buyer from 1st viewing.

2. There is a conflict of interest in this case where agent did not declare that the seller agent is his colleague, therefore you have a case that can be brought up to the regulatory body for investigations, do prepared to spend some time to assist in the investigations as well as provide necessary evidence of what you have mentioned here.

Hi JY,

1) If the agent is representing the buyer, then the agent owns a fiduciary duty to the buyer.
2) The agent should be acting in your best interest. If looking from this angle then the agent supposes to come clean to you right from the beginning.
3) So you can say that the agent's action did not reflect the above responsibility.
4) This complaint is valid.

Please give me a thumbs-up if the answer provided is relevant to your main concern. Thanks!!!
