I want to take over my ex husband's share of Private Property- Condo. The property is Tenancy in common. We still have outstanding mortgage. If I need to buy out his share, what calculation is done ?

Hi,

You have to buy over his ownership share proportion amount of the loan, and also refund his CPF utilized + accrued interest. Also the relevant buyer stamp duties have to be paid based on market value of the share of ownership transferred.

Hi, you will firstly have to buy over his share of the condo, followed by taking over the loan amount. This means you will have to refund all the CPF+interest accrued used for loan repayment, stamp duty as well as the amount his share is deemed.

Is there any court order for the takeover? If your ex ok with this arrangement. You will need to be able to refund his CPF monies used for the property plus the accrued interest minimally and have the necessary financial capacity to undertake the balance loan amount on your own.
