I would like to know what clause can I input in the TA if in the event my grandpa passed away?

He instructed me to find agent to rent out his HDB flat (MOP longer ago) as he’s currently staying with me. But I would like to know if he passed away, with a will & his flat is rented out. How do we tell the tenants to move out & that the house need to sell away according to the grant of probate? Is sale without tenancy clause in the TA sufficient?

I’m asking because we are weighing the options to either rent out or just leave it as it is.

Hi,

For HDB leases, usually there's a clause to state that the Tenant has to move out of the flat should the Owner sell the flat. HDB cannot be purchased with tenancy, as the new Buyers will need to serve the MOP.

It is possible to rent out the flat now, with this clause in place. Do let me know should you require further assistance.

Hi, appreciate your sharing. In the event if he is not around, subject to HDB approval for renting out. For HDB sorry can't sell with tenancy, have to sold vacant.

HDB cannot be sold with tenancy, thus in the event of a sale, the tenant will be required to move out, and in the event of the demise of owner, should the beneficiary be unable to retain the flat and continue to rent out the property, there is no room for the tenant to claim any damages in the event of premature termination of lease.

Dear Sir/Mdm,

For HDB flat, they are not allowed to be sold with tenancy. When the landlord passed away, HDB will instruct the beneficiary of the flat to either inherit the flat if they are eligible or sell the flat in the open market.
