Good afternoon d,

both of you are married and you understand that to form a family nucleus, both names need to be included thus you probably thinking of you as owner while she is as essential occupier.

I am afraid to inform you that as long as she is included in the purchase, she will have to adhere to the same restrictions as you. She will have to dispose off overseas property within 6 months from resale completion date.

Unfortunately yes, both buyers and essential occupiers are required to sell off all local and overseas properties within 6 months of getting the resale HDB.

Also, both owners and occupiers will need to fulfill the 5-year MOP.

Hi,

1) When comes to buy HDB flats, it is very clear that all owners and occupiers have to dispose of their private residential property (local and overseas).
2) You can be a single borrower for the flat, but you must be one of the owners of the flat or the sole owner of the flat.
3) Since both of you are SC, there is no issue for her to remain as an occupier, and you be the sole owner.
4) When you are married, your spouse will automatically be the essential occupier and must observe the 5 yrs MOP.

5) Your wife has to sell her overseas residential property within 6 months upon key collection. If you have a special reason why she is unable to do it, you may put up an appeal to the HDB for consideration.

6) All appeals are deal with on a case-by-case basis, thus no historical case can be referred to.
