my father brought a land and build a house in 1996 My father expired on april 2009, he had not makes a will, in this time my family members include my mother, elder brother and two sisters, I want to knows that my mother is the only property owner or all family members have rights in this property if all the family members have rights in this property what document i will make that my mother is the only right in this property and my mother makes a will through own wish.

Evening,

Under the Will and Estate ruling, your mum who is your dad's legal wife, will have the rights over the property even if your late dad bought the land under his name only.

Hi Sunil,

If your dad did not make a will, it will be up to the Public Trustee to administer the estate and distribute it according to the Succession Act.

The share each would be determined by how many qualifying persons there are, eg: siblings, parents, children.
