Need help in buying Private Condo:

1) I'm Singaporean but my husband is foreigner. Can I omit his name in Owner/Occupier for purchase of a Condominium to avoid ABSD?

2) When he gets PR in the future, can I add his name in? What's the legal procedure if can, and estimated cost?

Hi Vernice,

If this property is going to be your joint name 1st purchase, you may be eligible for ABSD remission and can avoid the higher ABSD rate. Alternatively you can also purchase under your own sole name. When he gets PR status you can still add his name in. The prevailing stamp duties will apply and also legal fees of approx 3-5k.

If this purchase is to be jointly-purchased as your first matrimonial home, you are eligible for ABSD remission. You need not pay any ABSD in this case.

If you currently owns a property, then you might want to purchase it under your name, and then upon him getting his PR, he can then purchase a 1% share (to save on stamp duties and transaction cost) of the property from you. By being a co-owner, he will be eligible to loan against the property.

Hello Vernice,

In the event that you omit your spouse name as co-owner, the mortgage loan will be computed based on your income solely. If you have enough fund, you can do it in that manner. However when your spouse obtain his SPR, I would recommend that you do not add him as co-owner but buy another property under his name so as the save on the ABSD payable.

You will not be required to pay an ABSD as this will be your first matrimonial property with your foreigner husband.

Buying the property under both names will also make sense as you will be able to secure a loan based on both your incomes.
