The seller wants to delay the completion of our HDB resale for the purpose of allow his tenants to stay on for 2 more months. I have received the OTP (scanned) but have not exercised it yet. I understand that such extension of stay/delay of completion should not be for the purpose of fulfilling the sellers rental agreement and thus am not comfortable with the arrangement. What are my best options?

Hi,

1) A verbal agreement is also one type of agreement, as a gentleman should honour his word.
2) If this has been discussed and agreed upon before signing the OTP. Personally feels that you should honour your word.
3) However, if this was not told before issuing of OTP, then it is up to you to decide.
4) A formal extension can only be approved by HDB is such that seller able to produce evidence of exercised OTP or key collection for BTO.
5) Scanned OTP cannot used for exercising. You have to sign on the actual OTP to be formally exercise the OTP.
6) Personally feels that you already aware there is a tenant staying in your favour unit when offer for an OTP. I don't think there is any issue for allowing tenant continue staying there till end of the tenancy.
Just take it that sellers are staying there during this extension period.
