Who comes up with the agreement for 3 months extension? Buyer (DIY) or seller’s agent?

If we agree to 3 months extension and exercised it but we didn’t discuss the terms and conditions, is it still possible to discuss the payment regarding the town council fee, tax, and all, before submitting to hdb?

Hi there,

Typically a 3 mths extension is required by seller in order for them to have sufficient time for renovation of their next place.

With regards to the town council fee, the sellers would pay for the 3mths fee.

Property tax shall be prorated accordingly to the 3mths. The agents involved in this transaction will be able to assist with it.

There is no default on who should come up with the agreement for 3 months extension but usually agent will undertake this task. If nothing has been discussed, it could be sensitive to bring this up now. From buyer's perspective, this could mean losing out on the rental as well as the various outstanding tax and conservation charges if it has not been discussed. The seller may indicate that this should be borne by the buyers as it is part of the consideration when they accepted the offer.

The thing is that the extension period should be updated to HDB when doing resale application.

Hi,

1) The 3-months extension stay after completion of sale was introduced by the HDB.
2) There are many reasons over this. You may write to the HDB to get a clarification.
3) It is important that you discuss all the costs imposed during the extention stay period.
4) Honestly, to grant an extension stay after completion is a good gesture from a buyer. Thus, you should not be bearing any essential costs.
5) But, not all people thinking alike.
6) I would recommend you to discuss on the costs with the seller and have them written in black and white with both party's signature to protect yourself. Make sure there is witness for both parties when there is a deal.
