Can I sell my house without my spouse in Singapore? Status is still married. I understand when I sell the house, CPF will go back to each spouse CPF account and the cash proceeds will be spilt half right? Can the cash proceeds 100% go to one spouse only if the other spouse agree? What is the procedure for the cash proceeds to go to one spouse only?

Hi,

Your spouse still has to sign and give her consent for the sale as she is a co-owner of the house. Is she agreeable to the sale? Yes the CPF utilized + accrued interest of each owner for the property will go back to the respective accounts upon the sale. The sale cash proceeds can go to one spouse only but you have to engage law firm to work on and draft the legal document for both owners to sign.

All owners will need to sign the OTP and agree for the HDB sale to happen.

CPF refund will be back to each individual's CPF-OA.

The Cash proceeds will be in form of a cashier order to all owners. You will need a joint-bank account to bank in the cashier's order. From then on, it's up to the parties to split the sale proceeds.

Hi,

1) No matter if it is an HDB or a private condo you are referring to. You can't sell it without the consent from the co-owners.
2) The OTP has to be issued with both owners.
3) The cash proceeds will only be split if there are documents and evidence for the lawyer to act accordingly.
4) Otherwise the cashier order will be issued to all the owners. The owners have to deposit it in a joint account in order to withdraw the money.
5) You may consult a lawyer on the details.

1. If your spouse is co-owner of the house, both you and your spouse will need to provide consent to sell your house. if your spouse not in Singapore, if your spouse consent to sell the house then you acn proceed to sell.

When you sell the house, the CPF (Central Provident Fund) proceeds will be returned to each owner respective CPF account. As for the cash proceeds, they are usually split equally between both spouses for joint tenancy.

To proceed with the cash proceeds going to one spouse only, you and your spouse will need to come to an agreement and execute a legal document. It is advisable to consult a lawyer who specializes on this

Dear sir/madam,

If you are referring to HDB, you will require spouse's consent to sell even if you are the sole owner of the property. In this case since you have mentioned that CPF will be refunded to each spouse's CPF, I am assuming that this property is under joint ownership, thus both parties will be required to sign on the Option To Purchase as well as other relevant documents in order to effect the sale. In terms of the proceeds, both of you will need to agree on how it can be managed and will require a private conveyancing lawyer to work on the proceeds arrangement, even if it is a HDB sale. If you are referring to a HDB flat, then spouse consent is required even if your spouse is not an owner when selling the unit. Yes sale proceeds can go to 1 party if the other party is agreeable.
