I believe there should be a court order with regards to the matrimonial flat with her ex-husband in this case, so you will need to look into this court order before we can advise on what can b done with this flat, including the transfer of the unit to you. HDB's criteria to sublet the unit is quite straightforward, as long as it is a Singapore Citizen household and have met the 5 years Minimum Occupation Period, you will be eligible to rent, however, if there is any matrimonial disputes and etc, we will need to look into this separately.
