Hi Dear Gurus,

If I sold my 4rm HDB flat and it is a negative sales, I calculated and it short of about $39k to $44k to fully return back to our CPF OA acc. The shortfall of $44k do I need to top up in cash or I can write in to CPF board to waive off ? The following is my example, please advise. Thank you very much Gurus :)

Selling Price : $400k
Outstanding Loan : $72k
CPF + Accrued Interest : $372k
Sales Proceed : - $44k (negative)

Good morning Sir/ Mdm,

Most clients who experienced this didnt not top up the negative sale (in your case, $44k) in cash back to CPF cause they sold their units on or above valuation.

You can write in to CPF board yourself or law firm if you use private lawyer to request for waiver subject to approval (usually okay).

Hi,

If you are able to sell at or above valuation price, for negative sales typically there is no need to top up in cash for the CPF refund portion that cannot be covered by the sale price.

I have worked on similar cases and help clients to successfully resolve this issue. The key is to sell at reasonable price range and estimate a price close to the valuation. 1) The condition to get wavier for this shortfall is your flat must be sold at or above market value.
2) After selling, you just need to make use of the econcierge in your CPF account to appeal to the CPF board for the waiver.

I have personally transacted many negative sale units and none of my clients are required to top up the shortfall in their CPF. However, it is important to note that we will need to transact the property at a price which is at or higher than market valuation.

Not to worry at all. If you sell your HDB flat at or above Valuation, you need not refund the negative portion back to your CPF. CPF will just treat this as an "investment loss".
