hi good afternoon. can i ask if i want my tenant to move before 6 months i need to pay them anything?
i am the only child my parents will give me their hdb flat which is fully paid. after they pass on i sell the flat the money will give me in cash? or need to go to my cpf account thank you

Hi,

Can I clarify are you referring to 2 different flats? Not sure why you would need the tenant to move if you already have a place to stay?

For owners who have passed on, the property will go to the beneficiary according to their Will. So if you are the sole beneficiary, assuming you are not eligible to keep the HDB due to you having another property, then the HDB has to be sold in the open market. After its sold, the sale proceeds will go toward the Estate bank account, and distributed according to the instructions of the Will.

Hi,

regarding asking the tenant to move out before their tenancy is due, it all depends on the clauses written in the tenancy agreement. Most agreements will state whether there will be any penalty or how many months of notice needs to be given.

As for the sales proceeds of the flat, it need not go back to the CPF account. After all the deductions, from agent fees to legal fees and other fees.

The tenancy agreement is legal binding and therefore you will not be able to ask the tenant to move out earlier unless they agreed to it or you can offer them some form of compensation for moving out.
