Hi Gurus,

I have put in an offer for a resale condo listing which stated: “$xx negotiable”. Initially offered at a price slightly lower, but was pressured by the agent to put in a better offer. As such I put in an offer at the listing price.

The agent was coming up with all sorts of reason to delay the update to me and now I found out that the listing had changed to “$xx starting from”. He is also continuing to allow viewings. Separately he updated me that the buyer will make a decision in a few days (after conducting the last round of viewing).

I felt that this is very unethical and they are basically using my offer (given cheque) to raise the purchase price. Is this an ethical conduct and is there any breach of conduct that is liable for punishment?

How can i also make sure that I still get the offer accepted?

Sellers agents main responsibilities are to sell the property at the highest price possible for the owners, thus they are technically not at fault to try push for higher offers with. your offers, although it leaves a very bad taste and should have been managed better.

Whether you can still get the offer accepted or not will really depends on the situation on the ground as you may require a different negotiation and offer strategy. Are you a direct buyer to this listing or you went in with another agent that is representing you?

Hi,

It may be the seller that is shifting goalposts on his/her desired price, and however frustrating it is, it does happen for units that are quite in demand. The seller agent maybe could have communicated and manage the expectations better but his/her hands are tied as the seller ultimately holds the right to decide on whether to take up the offer. In such situation I may advise the buyer (if I am representing the buyer) to move on with another unit since the sellers are not decisive and the process can drag. Even if the offer is accepted, there is still a 10 week conveyancing period where you have to stomach the uncertainty of the seller's actions since he/she has shown to be indecisive and may raise some issue prior to completion.

Hi,

1) Buying a house is always not an easy task especially it involved a large amount of money.
2) Although the sellers' agent did not manage your offer as per your expectation, he did nothing wrong by trying to match the sellers' expectations. Since the sellers are his paymaster.
3) There was no contract formed in your negotiation process since there are 3 elements needed to be in before a contract is formed.
4) You are putting up an offer with consideration but the sellers did not accept your offer, thus no contract was formed.
5) I would suggest you engage an agent to assist in your purchase rather than go by yourself.
6) Your agent would have smoothened the whole purchase process and it is free to you anyway.
