HDB has no jurisdiction to decide whether you take over or to sell. Your lawyer should be able to advise you better in this scenario. When you mention that you have a right to buy over and if you intend to but your ex do not consent this, you may apply for court order to have him comply to such arrangement from my understanding. Not sure if this is what your lawyer has advised as well.
