Hi Gurus...I own a condo which is rented currently....now I am planning to sell off but tenant is not cooperating...He is not allowing my agent to show the unit to buyers ...He is saying that he will only allow viewing 2 months prior to the end of contract...pls advise ...what Should I do?

Hi,

I am not sure what is inked in the Tenancy Agreement, but typically it includes a clause where the owner is allowed to show the units to prospective buyers. But then again, it is always best to find the most amicable solution such that it minimizes the inconvenience to the tenant and yet viewings are workable (Perhaps a mutually agreeable date & timing slot). After all, there's still quite some time before the tenancy expires and you wouldn't want to jeopardize the working relationship. May I have more info and requirements about your plans so to make better recommendations? Thanks and look forward to value-add to your housing plans.

Hi, it will depend on what was written on the TA itself. Anyway it is still possible but I would suggest that you drop by the unit personally and have a good discussion with the tenant. Pls feel free to let me know if you need any assistance.

Dear seller,

I understand your frustrations on this encounter. Has anyone actually explained that it is part of tenant's covenant to allow viewings for sale in the first place? I will usually have prior agreement with the tenant to have common understanding on viewing arrangements, as we are aware that it also creates inconvenience on the tenant's end for each viewing conducted and with this understanding, I have managed to complete sales transactions with tenancy.

Good evening owner,

let's look at the big picture rather than being frustrated by current situation.

First relook your TA on the terms and conditions. Usually most TAs will have a clause that in the event owner will like to sell the house, tenants must allow viewings at reasonable time.

Subsequently arrange a meet up with the tenants to explain the situation and resolve it amicably.

Perhaps you can propose to show the unit at certain time and frequency ie. Sunday 2 to 3pm.

It usually states that viewing should be permitted 2 mths prior to the end of the lease ...

Not every TA states that WHENEVER THE OWNER PLANS TO SELL, TENANT MUST ALLOW VIEWING.

So your tenant may not be unreasonable ...
