Hi! My parents own a 4-room HDB flat under joint tenancy. My father has lost his mental capacity but with no LPA done. Can my mother sell the flat & buy over my 5-room HDB flat? Thanks.

Hi,

As there is no lasting power of attorney applied, you would have to go through a law firm to assist to apply to the courts to have a deputy appointed to manage your father's affairs and also his interest ownership in this property. It can take some time for the procedures and it is best to appoint a law firm to assist on such matters.
