TLDR: My boyfriend is planning to get a resale
flat under his name as I am currently listed as an essential occupier for my brother’s BTO. Can my boyfriend and I still get married?

I’m currently listed as an essential occupier for my brother’s BTO and the MOP for the unit would be end 2024.

As we didn’t want to wait till after 2024 to have our own place, my boyfriend decided to get a resale flat under his name first. We are planning to get married next year or the year after.

We are aware that if 2 singles have their own HDB, one of them would have to give up by selling the HDB after they get married. However, in my case as an essential occupier, how do we go about it? If I were to get married, will my brother have to give up his BTO since the MOP hasn’t reach yet? Or my boyfriend has to give up his resale HDB after we get married since I can’t pull my name over to his HDB before the MOP for my brother’s BTO. Is it possible for us to get married still, with my boyfriend and brother both getting to keep their unit and for me to transfer my name to my boyfriend’s unit after end 2024?

Or is it possible to appeal to HDB in my case?

We are looking at HDB units only as we are not able to afford private housing.

Hi,

1) Some important factors you didn't mention, thus my suggestion might not be relevant.
(a) Age of all the people involved.
(b) Your brother & yourself had used either an Orphan scheme or a joint single scheme.

2) If your brother age 35 and above then things can be simpler. He can own the flat without your involvement. Thus whether you are the essential occupier is not important.
3) If your brother is below 35 years old, and needed you listed as the essential occupier, means the flat is bought under the Orphan scheme. Thus you are not allowed to purchase HDB with anyone.
4) If your boyfriend is age 35 & above, he can purchase using a single citizen scheme.
5) In the general cases under current policy, your name is not allowed to use as an essential occupier in another flat purchase under MOP.
6) You may still marry and stay together as per normal except your name is not listed under your husband's flat.
7) You can change your residential address as norm.
