Hi, I am getting a divorce. Me and my wife own a private property. Can we both continue owning the property in joint tenancy after the divorce? The reason we are doing this is because we want to hand over the house to our child after he turns 21. We also used our CPF to pay for this house, will there be any implications after we divorce?

Hi

As it is a private property, both of you are eligible to maintain the joint tenancy ownership after the divorce, but this is subjected to the court order approval and also mutual agreement of terms relating to the matrimonial property arrangements.

I assume the property is no longer under home loan. As it requires a transfer of ownership to your son upon turning 21, the CPF utilized + accrued interest both of you have used for the property have to be refunded to your CPF accounts, the incoming owner (your son) has to refund that to you all. One way is to use your joint cash savings to help him to achieve this.

There should be no issue about retaining this property under joint tenancy after your divorce proceedings since this is a private property. Nevertheless, do take note that if this property is passed to your child, both of you will be required to refund all the CPF monies used including the accrued interest to your respective account. 1. As private property owners, you can continue to own the property after a divorce, based on the Court Order and mutual agreement.
2. Since this is private property, there should be no issue with keeping it under joint tenancy post-divorce.
3. If the property is passed to your child, both parties must return any CPF used, including the accrued interest, to your respective accounts.
