Hi, your husband will be compelled to sell if final judgement ask for the sale of the flat. In the case he still doesn't compel, I think the court will allow you to carry out the sale of flat. Perhaps you can check with a lawyer on their professional advice on this aspect.

Usually in the court order, it will indicate The Registrar is legally empowered to sign on his behalf since it is legally required to be sold within a certain timeline. However, it is still ideal to speak to him and understand his concerns for the sale, especially if he is still staying there in the unit, so to have a smooth resale process of the sale.

By the way, it is possible for you to sign alone but it will take quite some time to get court order done and I do have a similar case a few years back. The poor wife has to run to and fro to the lawyer office just simply because the ex husband refuses to sell nor sign any legal document. And it took more than a year for the court to approve.

In such incidents, typically you will need to apply to court where they will enforce the sale if your ex husband still do not comply with the court order when time is up.
