My spouse and I are doing transfer of ownership of HDB after divorce. I understand, I have to refund my spouses CPF, but for remaining balance of the loan, Can I continue the ongoing loan that I have with HDB?

Once the ownership is transferred, only the sole owner can use his or her CPF to service the mortgage loan. Therefore, it is important to check whether the person taking over the flat is able to take up a sufficient loan to buy over the other parties share of the house.

It is not so straightforward, you will have to do a re-assessment of your attainable loan amount so HDB can assess whether you are able to take over financially. You also have to refund the CPF utilized + accrued interest of your spouse for the property for him or her to exit. Relevant buyer stamp duties will also have to be paid, based on the market value of the share ownership transferred.

Hi,

1) No matter you are getting your loan from the HDB or banks. You will still need to apply for an HFE in order to complete this part-share sales.
2) * Note that there is a box to tick to indicate that this is a part-share buying in the HFE.
3) The HDB will know and will take in consideration of the current loan commitment and tabulate the loan accordingly.
4) The HDB will combine both loan into one.
