The flat was bought by my parents, unfortunately, my dad had passed on in 1997. Moving forward, my name was added to co-owner with my mother. I'm having the idea to downgrade the housing to 2-room upon reaching 35 years old. I have a few questions for this.

1) Will I be able to have any HDB grant being that my name was added in to current flat's owner? And if there's any difference to the grants if i purchase alone or with my mother for the new BTO flat?
2) As my mother had a child in Malaysia, in the event of my mother's passing, will he be able to raise any discrepancy when it comes to flat sales proceed in any way?

Hi,

Typically if your name was added to fulfill family nucleus eligibility, if no grants are taken back then when the addition was done, it is most likely you are still considered first-timer status. There may still be HDB grants available if you still fulfil the eligibility criteria. It may be better for you to purchase alone, if your mother is already a 2nd-timer, because resale levy will apply if you all jointly apply for BTO due to her 2nd timer status.

You can discuss with your mother and have her set up a Will to indicate the fair allocation of proceeds in the event of her passing. This I guess can help to alleviate your concerns now.

1. For your case, since your name was added to become a co-owner, HDB may regard you to have utilise the first timer status. To confirm on this, it is best to check directly with HDB branch office. For the BTO purchase, it depends on whether HDB regards you as a 2nd timer because resale levy is applicable for a 2nd timer.

2. Only the owner of the flat is entitled to the sale proceeds. In this case, if the child is not an owner of the flat then he will not be entitled to the proceeds.

IF you are intending to purchase a BTO with your mum, this itself is considered a subsidised unit. If the existing flat purchased by your parents are also BTO flat or a resale flat purchased with housing grants, it could be likely that you will be considered a 2nd timer given that your name is added into the unit, thus it is best to seek advise and clarifications with HDB for more accurate understanding.

If there is concern about your sibling claiming part of the sales proceeds in the event of your mother's passing, perhaps it will be best to set up a will to indicate how the proceeds can be arranged.
