The TA was signed subjected to some pre-requisite conditions (provided in writing in whats app) to be fulfilled by the Landlord, we continued to follow up on the conditions later. After around 48 hours, the agent informed that the landlord has signed the TA but the conditions will not be met and tried to propose an alternative arrangement. We did not like the arrangement and decided to pull out of the TA as there was broken agreement and breach of trust. We immediately informed the agent to find other tenant and finalized a different property as the moving-out date was near. We did not pay any security deposit, did not pay the stamp duty. After 21 days the agent is asking for compensation first he asked for 1 months security, than later he asked for half months security deposit.

Hi, this is a tricky situation where in black and white TA you signed the agreement to accept the condition of the rental unit. However since it is in written in whatsapp of your conditions, you might be in the right . You can choose to not pay the security deposit to the landlord , whereas the landlord also has the right to take you to small claims tribunal , in which case the judge will be the one to decide who is in the right . In future if you want to avoid such situation, you can consider approaching a agent to assist in your property transactions .

I don't see any reasons for the agent to claim when he or she should not have even proceeded to arrange for the Tenancy Agreement without any deposit. There is no offer to talk about when there isn't any considerations (deposit) made, this is what I have learnt before I became a practising RES, unless I was taught wrongly.
