I have made a direct offer to the sellers agent. Price was accepted by sellers in WhatsApp. With this I actually let go of my house and signed my OTP with my buyers.

I requested for 2 conditions, to have an LDAU approved and timeline extended. This was a Thursday and I requested for her to come back to me on Friday if there is any changes needed. I asked her on Friday if there is any updates, she asked if I can wait. So I mentioned ok and if there is any changes needed, please let me know. Monday i texted her because she didn’t revert. And she mentioned sellers have accepted the same price without any conditions. I’m abit shocked about why didn’t she come back to tell me at least because my offer is accepted and just needed some changes. And now she is not answering.

Is there anything legally I can do?

The key thing is that as long as the seller has not officially inked the Option To Purchase, they are still open to accept and discuss all other offers.

I am unsure of the exact situation, but sometimes, sellers themselves are the one who change minds especially so if they have engaged more than 1 agent to market their property for sale. Whether do you have any legal recourse, I am afraid you may wish to seek advise from your lawyer on what actions can be taken against the seller or agent. What do you wish to get out from the current situation?

From what I have gathered, the most you can do is to lodge a formal complain against this agent for failing to update you the situation despite asking if you are able to wait but did not get back to you. Read More

Nothing is confirmed till it is signed on the dotted line. The verbal acceptance is not accompanied by an OTP and Option fee hence there is no legal binding between the parties.
As of current, since your OTP has been issued, the current resolution is to work things out with your buyers, and actively hunt for something that fits your requirement.

Hi Sir/Mdm,

Unfortunately there is nothing you can do because for a legal relationship to be form, there must be an acceptance and a consideration. In this case, there is acceptance by the seller but you didnt pay the seller the option fee.

You may want to quickly find another house to purchase since you have a already sold your place. It is advisable to engage an agent to assist you in the purchase so that your interests can be best protected during the negotiation process.
